Terms of service. In plain words.
What you agree to when you use Dayrun, and what we agree to.
Updated 15 September 2026
Who this is between
These terms are between the company that operates Dayrun, named in our legal notice, and the business that holds the account. If you accept them for a business, you are confirming you have authority to bind it.
Dayrun is built for businesses. It is not offered to consumers for personal, family or household use.
What we provide
Dayrun provides AI staff that answer calls and messages on the numbers and channels you connect, and take actions in the systems you connect them to, inside the limits you set.
Dayrun's staff are software. They say so, they hand a conversation to a person when they should, and you must not present them as people.
We may add, change or retire features. If a change removes something you rely on, we will tell you in advance.
Your account
Keep sign in details to the people who should have them, and turn on the protections we offer, such as two factor sign in. You are responsible for what happens under your account.
Tell us straight away at [email protected] if you think your account has been accessed without permission.
What you are responsible for
The numbers, channels and systems you connect, and your right to connect them.
The instructions, knowledge and limits you give your AI staff, and checking that the answers they give from them are right for your business.
Telling your customers that calls may be answered by AI, recorded and transcribed, and getting their consent where the law requires it. Some places require every party to a call to agree to recording.
Following the laws that apply to contacting people, including the Spam Act 2003 and the Do Not Call Register in Australia, the Telephone Consumer Protection Act in the United States, and equivalent laws where your customers are.
Having a lawful basis for any personal information you give us, and telling your customers how their information is used, including that you use Dayrun.
What you must not do
Use Dayrun to mislead somebody about who or what they are talking to, to contact people who have asked you not to, to harass anyone, or to break the law where you or they are.
Use Dayrun for emergency services, or to give medical, legal or financial advice that someone will rely on without a qualified person reviewing it.
Send us payment card numbers, government identifiers or health information beyond what a booking needs, unless we have agreed in writing how it will be handled.
Resell Dayrun as your own, work around usage limits, copy or reverse engineer the service, scrape it, or test it for weaknesses without our written permission.
AI output
AI staff can mishear, misunderstand or get something wrong. Keep a person in the loop for anything you cannot afford to get wrong, and review what your staff do.
Output is produced for your business. It is not professional advice, and we do not guarantee it is complete or accurate.
Your data
Your calls, messages, recordings, transcripts, customers and bookings are yours. You give us permission to hold and process them only to provide, secure and support the service for you.
We never use your data or your customers' data to train AI models, ours or anyone else's, and we choose providers and settings that keep it that way.
We use service measurements, such as call volumes and response times, to run and improve Dayrun. They never include the content of your conversations.
Data protection
When we handle your customers' personal information, we do it on your behalf and on your instructions. Under GDPR we are your processor, and under the CCPA we are your service provider.
Our privacy policy explains how personal information is handled. A Data Processing Addendum, including the EU Standard Contractual Clauses and the UK Addendum, is available at [email protected] and forms part of these terms once signed.
We keep a list of the providers that process personal information for us and will tell account holders before we add one that handles customer conversations.
We will help you respond to requests from your customers and meet your obligations if a data breach affects them.
Security and confidentiality
We protect your data with encryption in transit and at rest, access limited to the people and services that need it, and monitoring for misuse. No system is perfectly secure, and we will tell you promptly if a breach affects your data.
Each of us will keep the other's non public information confidential and use it only for this agreement.
Other services
Dayrun works with services run by others, such as phone carriers, WhatsApp, calendars and payment providers. Their terms apply to your use of them, and we are not responsible when one of them is unavailable or changes how it works.
Money
A subscription for each location, then the calls, messages and models that location actually uses. Prices exclude GST and other taxes unless stated.
Customer payments run through your own payment provider, never through us. We never hold your customers' money.
We will give you at least thirty days notice of a price change. If an invoice is overdue, we may pause the service after telling you.
Stopping
You can stop at any time. For thirty days after you close your account you can export what we hold, and after that we delete it, except records the law requires us to keep.
We can suspend or close an account that is breaking these terms, putting others at risk or not paying. We will tell you why and, where we can, give you a chance to fix it first.
Liability
We provide the service as it is. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data you could have kept, and our total liability is limited to what you paid us in the twelve months before the event.
Nothing in these terms excludes a right or guarantee you have under the Australian Consumer Law, or any liability that cannot lawfully be limited. Where a guarantee cannot be excluded, our liability is limited, where the law allows, to supplying the service again or paying for it to be supplied again.
You will cover us for claims that arise from your content, from using Dayrun unlawfully, or from not getting a consent you were required to get.
Changes, law and disputes
If we change these terms in a way that matters, we will tell account holders at least thirty days before it takes effect.
These terms are governed by the law of New South Wales, Australia, and the courts of New South Wales have jurisdiction. Before going to court, each of us will try in good faith to resolve a dispute by talking first.
